Case underscores duty of owners to properly restrain animals with known aggressive behavior
AUSTIN, Texas — With spring weather bringing more backyard gatherings across Central Texas, a recent injury case involving a U.S. Army veteran is raising concerns about the risks of unrestrained dogs with known aggressive behavior.
The case, which resulted in a $500,000 settlement, stems from a 2022 incident in which the veteran and his wife attended a get-together at a coworker’s home. Upon arrival, the homeowners acknowledged that their two dogs—one a Standard Poodle and the other a Poodle-Italian Bracco mix—had a history of aggressive behavior. As a precaution, the dogs were initially locked upstairs while guests gathered in the backyard near the swimming pool.
Later in the day, the veteran entered the home to use the restroom. At that time, both dogs were loose inside the residence. The female homeowner attempted to restrain the dogs by their collars, but one broke free and attacked the veteran as he walked through the home. He was bitten in the groin area and also suffered a serious injury to his left shoulder.
The veteran sought emergency medical care the following day, where he received multiple injections to the bite wound, imaging on his shoulder, and had his arm placed in a sling. His injuries ultimately required two surgical procedures to repair his rotator cuff. In the months following the attack, he also began experiencing ongoing sleep disturbances and nightmares related to the incident.
“The reality is that dog owners have a responsibility to control animals they know may pose a danger to others,” said Arash Karimi, attorney at Daniel Stark Injury Lawyers. “When that responsibility is not taken seriously, the consequences can be life-changing—especially when an unprovoked attack leaves an innocent person seriously injured.”
