Case highlights the devastating impact of commercial truck crashes after a Central Texas volunteer’s life changed forever despite doing everything right.

AUSTIN, Texas — A Central Texas woman who spent the day volunteering with Habitat for Humanity suffered life-altering injuries when a commercial truck crossed the centerline and struck her head-on, a crash that later resulted in a $1.1 million settlement.
The 57-year-old woman was traveling westbound on Nov. 21, 2024, near County Road 269 in Bertram, Texas. According to the lawsuit, a commercial tractor-trailer traveling eastbound swerved into oncoming traffic while attempting to avoid a stopped passenger vehicle. The truck crossed the centerline and struck the woman’s Subaru head-on.
Emergency responders had to extricate her from the vehicle due to the severity of the impact.
She sustained significant injuries, including third-degree burns to her left arm, a severe left ankle fracture requiring surgical repair with pins and plates, multiple broken bones in her right foot, and a right knee injury requiring surgery.
Head-on crashes involving large commercial trucks often result in catastrophic injuries due to the size and weight difference between passenger vehicles and commercial vehicles. The case serves as a reminder of the importance of safe following distances, attentive driving and proper defensive decision-making behind the wheel.
Before the crash, the woman led an active and structured life built around both her career and her community. She managed a team and was pursuing additional certifications intended to advance her professionally.
She continues to live with significant limitations from her injuries, including difficulty walking and performing routine daily activities. She also developed anxiety about driving, and activities that were once part of her normal routine, such as spending time outdoors and caring for her dogs, are now more limited.
Her recovery has required ongoing support from her wife, who served as her primary caregiver throughout treatment. What was once an active, independent lifestyle has shifted to one centered on recovery and long-term physical limitations.
Attorney Cory Smith, an Austin-based attorney with Daniel Stark Injury Lawyers, said the case highlighted the importance of understanding a client’s life beyond medical records and bills.
“She spent the day helping someone else build a home, and by the end of the afternoon, her own life had been completely changed,” Smith said. “That’s what this case was really about.
Insurance companies often want to reduce people’s lives to medical bills. But that is not the full story. Our client had to completely change her daily life, her work, and the way she moves through the world. They questioned whether that loss is actually worth anything. But to her, it changed everything.”
The commercial carrier’s insurance company initially offered $200,000 to settle the claim.
After litigation, the case ultimately resolved for $1,108,203.
